Introduction and Acceptance of Terms

Welcome to AI Kiss, AI Kiss One Stop AI SAAS for AI-assisted image and video generation, editing, and related creative tools. By accessing or using our service, you agree to be bound by these Terms of Service. If you do not agree with any of these terms, please do not use our service.

Prohibited Content

You may not use AI Kiss to generate, upload, publish, request, or distribute any of the following content:

  1. Pornographic or NSFW content: nudity, sexually explicit or sexually suggestive material, sexual exploitation, non-consensual intimate imagery, or sexual violence.
  2. Violent or graphic content: graphic injury, gore, torture, cruelty, glorification of violence, instructions facilitating serious physical harm, terrorism, or extremist violence.
  3. Hateful content: content that attacks, dehumanizes, threatens, or promotes discrimination or violence against people based on a protected characteristic.
  4. Child sexual abuse or unsafe child content: CSAM, sexualized depictions of minors, grooming, exploitation, or any content that places a child at risk. This category is subject to zero tolerance.
  5. Deepfakes and impersonation: deceptive or harmful depictions of a real person, impersonation, non-consensual intimate or romantic content, identity fraud, or content falsely presented as authentic.
  6. Copyright or trademark infringement: content that copies, misuses, or facilitates infringement of copyright, trademark, publicity, likeness, privacy, or other proprietary rights.

We also prohibit fraud, scams, harassment, doxxing, illegal activity, attempts to bypass safety controls, and misleading claims that AI-generated media is genuine when that deception could cause harm.

Child Safety and Consent

Never upload or generate sexual, romantic, exploitative, or otherwise unsafe content involving a person under 18. For romantic, kissing, intimate, or identity-sensitive media, every depicted person must be at least 18 years old, and you must have the informed consent of every identifiable person depicted. We may immediately block or remove suspected child-safety content, preserve relevant records, suspend the associated account, and report unlawful material to competent authorities or child-safety organizations when legally required or appropriate.

Content Moderation

We use a combination of automated controls, model-provider safety signals, and manual review. Depending on the feature, model, and available safety configuration, prompts and uploaded media may be checked by text or image safety classifiers before generation. Requests may be rejected when they trigger applicable content rules. Model providers may also reject or flag requests or outputs under their safety systems.

Content that is automatically flagged, reported by a user, or otherwise brought to our attention may be reviewed by authorized personnel together with relevant account and generation metadata. We may restrict access while a review is pending. Automated systems are not perfect, so users should report content that appears to violate these Terms.

Reporting Violations

Report suspected violations by emailing support@aikiss.art. Use the subject line Content Safety Report and include, where available:

  • The public URL, work identifier, or generation task identifier.
  • The category of violation and a concise explanation.
  • Relevant screenshots or other supporting information.
  • Your contact information if you want a response.
  • For intellectual-property reports, identification of the protected work or mark and the basis for your rights claim.

We handle reports in good faith, limit disclosure of reporter information where reasonably possible, and may request additional information. Knowingly false, abusive, or retaliatory reports may themselves violate these Terms. If there is an immediate threat to someone's safety, contact the appropriate emergency or law-enforcement authority in addition to reporting it to us.

Review and Response Process

We triage reports based on severity, review the available content and context, decide whether these Terms have been violated, and apply an appropriate action. Child safety, credible threats, and other potentially unlawful high-risk content receive priority. We aim to respond to a complete report within 14 business days or provide a status update if additional review is required. Complex legal or factual issues may take longer.

Enforcement Actions

Depending on severity, context, history, and applicable law, we may:

  • Reject or block a generation request.
  • Warn the user or require corrective action.
  • Remove content or prevent it from being published or shared.
  • Restrict features, generation access, or account capabilities.
  • Temporarily suspend or permanently terminate an account.
  • Preserve evidence and notify providers or affected rights holders.
  • Report suspected illegal activity to competent authorities when required or appropriate.

Severe violations, including CSAM, sexual exploitation, credible threats, or non-consensual intimate deepfakes, may result in immediate removal and account termination without a prior warning.

Appeals

If you believe an enforcement decision was made in error, email support@aikiss.art with the subject Content Moderation Appeal. Include the affected account, work or task identifier, the decision being appealed, and the reason you believe it should be reconsidered. We will review the available information and may uphold, modify, or reverse the original action.

Underlying AI Model Disclosure

AI Kiss is an independent product that provides access to multiple third-party AI generation technologies. Depending on the selected tool and current availability, the service uses models including:

  • ByteDance/Doubao Seedance 1.0 Pro Fast for certain AI kissing video workflows.
  • Google Nano Banana / Gemini image models for image generation and editing workflows.
  • ByteDance Seedream 4.5 for image generation.
  • Google Veo 3.1 and OpenAI Sora 2 for video generation.

Model availability, versions, and routing may change as the service is maintained. Where a generation interface offers model selection, the model name shown for the selected workflow identifies the model or model family made available to the user. References to third-party models do not imply sponsorship, endorsement, or official affiliation with their providers.

Use of the Service

AI Kiss provides tools that generate or edit images and videos using AI models. You agree to use the service in accordance with all applicable laws and these Terms, and not to misrepresent AI-generated media in a manner that could deceive or harm others.

User Accounts and Registration

  1. Account Creation: To access certain features of the service, you need to create an account. You must provide accurate and complete information during the registration process.
  2. Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
  3. User Responsibilities: You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

User Content and Visibility

Our service lets you generate, upload, or submit content ("User Content"). You retain ownership of your User Content, but you grant AI Kiss a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and distribute your User Content to operate and improve the service.

Your User Content may be public by default based on your subscription plan and the features we provide. For example, works created under a free plan are public by default and may be publicly visible and accessible to others. If your plan includes private works or we provide private options, you may change visibility using the tools we provide. Public User Content may be viewable by anyone and may be shared or indexed by third parties.

You are solely responsible for your User Content and for ensuring that you have all necessary rights and permissions to post it. You agree not to upload or share content that violates applicable laws or the rights of others.

Content Deletion

Users with an active paid subscription may delete their individual works at any time through their account settings. Free plan users do not have the ability to delete individual public works, as these are shared with the community under the terms of the free plan.

When you delete your account, your public User Content will be anonymized (author association removed) but may remain accessible on the platform. Private User Content will be permanently deleted along with your account.

Content and Intellectual Property Rights

All content provided through AI Kiss, including but not limited to software, services, documentation, and related materials, is protected under copyright law. The copyright owner of AI Kiss is aikiss.art.

  • You acknowledge that you do not own the underlying technology or intellectual property that makes up the AI Kiss service, and you agree to respect the intellectual property rights of aikiss.art and any third parties.
  • While you retain ownership of your custom implementations and modifications, the core AI Kiss platform and services remain the property of aikiss.art.

Prohibited Activities

You agree not to engage in any of the following prohibited activities while using AI Kiss:

  • Unauthorized access to or distribution of our proprietary content and services
  • Reselling or redistributing AI Kiss services without authorization
  • Interfering with or disrupting the security or performance of the service
  • Using the service for any illegal or unauthorized purpose
  • Violating the Prohibited Content rules above
  • Attempting to bypass any security features of the service

Privacy and Data Collection

AI Kiss collects the following types of data:

  • Account Information: Information you provide when creating an account
  • Usage Details: Data related to your activity on our service
  • Device Information: Information about the device you use to access our service
  • Cookies: Data that helps us enhance your experience with our service
  • Payment and Billing Information: Data necessary to process payments

Pricing and Payments

  • All purchases are final and non-refundable unless otherwise required by law
  • Prices are subject to change with notice to users
  • You agree to pay all charges associated with your selected plan
  • Payment terms are based on your selected payment method and plan

Termination and Account Deletion

We reserve the right to terminate or suspend your access to the service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users of the service, us, or third parties.

Account Deletion by User

You may request to delete your account at any time by contacting us at support@aikiss.art or through the account settings in the platform (if available). Upon account deletion:

  • Your personal account information will be permanently deleted or anonymized within 30 days.
  • Your private User Content will be permanently deleted.
  • Your public User Content will be anonymized (author association removed) but may remain on the platform as community content.
  • Any active subscriptions will be canceled, and no further charges will be made.
  • Deletion is irreversible. Once completed, your account and associated data cannot be recovered.

Data Retention

We retain certain data as required by law or for legitimate business purposes, including:

  • Transaction and billing records for up to 7 years (for tax and legal compliance).
  • Anonymized usage data for analytics and service improvement.
  • Data necessary to resolve disputes or enforce our agreements.

Disclaimer of Warranties

The service is provided on an "as is" and "as available" basis. We make no warranties or representations about the accuracy, reliability, or availability of the service and disclaim all warranties to the fullest extent permitted by law.

Limitation of Liability

To the fullest extent permitted by law, aikiss.art shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from the use of or inability to use the service.

Indemnification

You agree to indemnify and hold harmless aikiss.art, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from your use of the service or violation of these Terms.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which aikiss.art operates, without regard to its conflict of law provisions. Any disputes arising from these Terms or the service will be resolved through binding arbitration in accordance with applicable laws.

Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of the service after any changes signifies your acceptance of the new terms.
